These Terms of Service ("Terms") govern your access to and use of the IPTV Smarters Pro service, website and subscriptions ("Service") operated by IPTV Smarters Pro ("we", "us", "our"). By purchasing a subscription or using the Service, you ("you", "the user") confirm that you accept these Terms in full.

1. Definitions

"Service" refers to the IPTV subscription and streaming access provided by IPTV Smarters Pro, including channels, video-on-demand and related features. "Subscription" means a paid plan giving you access to the Service for a set period. "Player app" refers to any third-party media player (such as the IPTV Smarters Pro application) used to access the Service via Xtream Codes or an M3U playlist.

2. Eligibility

You must be at least 18 years of age, or the age of majority in your jurisdiction, to purchase a subscription. By using the Service you represent that you meet this requirement and that the information you provide to us is accurate and complete.

3. Subscriptions and payment

Subscriptions are offered on the plans and prices shown on our pricing page. Payment is required in advance and is processed through our payment channels. Once payment is confirmed, we deliver your login details (Xtream Codes) by email, typically within a short activation window. Prices are subject to change, but any change will not affect a subscription you have already paid for during its active term.

4. Licence and permitted use

Subject to these Terms, we grant you a personal, non-exclusive, non-transferable licence to access the Service for your own private, non-commercial use. Each subscription is intended for the number of simultaneous devices stated in your plan. You agree not to resell, redistribute, share or publicly broadcast the Service or your login details.

5. Account and login details

You are responsible for keeping your Xtream Codes and login details confidential. You must not share your credentials with third parties. We reserve the right to suspend or terminate a subscription where we detect sharing, resale or unauthorised use, without refund.

6. Acceptable use

You agree not to use the Service to: (a) breach any applicable law or the rights of others; (b) resell or commercially exploit the Service; (c) attempt to gain unauthorised access to our systems; (d) interfere with or disrupt the Service; or (e) use the Service in any way that could damage or overburden our infrastructure. We may suspend or terminate access for any breach of this section.

7. Third-party content and player apps

The Service is accessed through third-party player applications that we do not own or control. We are not responsible for the functionality, updates or policies of those applications. Any brand names, trademarks or logos referenced remain the property of their respective owners and are used for identification only.

8. Service availability

We work hard to keep the Service stable and available, but we do not guarantee uninterrupted or error-free access. The Service depends on your internet connection and on factors outside our control. Occasional maintenance, upgrades or disruptions may occur. Playback quality also depends on your device and connection speed.

9. Refunds

Our refund terms are set out in our Refund and Returns Policy. Where a money-back guarantee applies, it is subject to the conditions described there. No refund is given where a subscription has been terminated for breach of these Terms.

10. Disclaimer of warranties

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, to the fullest extent permitted by law. Nothing in these Terms excludes any consumer guarantee or right that cannot lawfully be excluded, including under the Australian Consumer Law.

11. Limitation of liability

To the maximum extent permitted by law, we will not be liable for any indirect, incidental or consequential loss arising from your use of, or inability to use, the Service. Where our liability cannot be excluded, it is limited to the amount you paid for your current subscription term.

12. Termination

You may stop using the Service at any time. We may suspend or terminate your access if you breach these Terms, if payment fails, or if we are required to do so by law. On termination, your right to use the Service ends immediately.

13. Privacy

Your use of the Service is also governed by our Privacy Policy, which explains how we collect and handle your information.

14. Changes to these Terms

We may update these Terms from time to time. The latest version will always be posted on this page with an updated date. Your continued use of the Service after any change means you accept the revised Terms.

15. Governing law

These Terms are governed by the laws of Australia. Any dispute arising in connection with the Service will be subject to the jurisdiction of the Australian courts.
